Disclosure Regarding Background Investigation

Disclosure to Applicant

In connection with your application to join the HALOFIX platform as an independent service professional (“Hero”), HALOFIX USA LLC (“HALOFIX” or “the Company”) may obtain one or more consumer reports and/or investigative consumer reports about you from a consumer reporting agency. These reports may include, but are not limited to:

  • Criminal history records (county, state, and federal)
  • Sex offender registry searches (including FDLE registry)
  • Identity verification
  • Florida DBPR professional license verification
  • Motor vehicle records (if applicable to services)
  • Public court records

Purpose

This information will be used solely for the purpose of evaluating your suitability to provide home services to Florida residents through the HALOFIX platform. The consumer report will not be used for any purpose other than as described herein.

Your Rights Under the Fair Credit Reporting Act

Under Section 1681b(b)(2)(A) of the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), you are entitled to the following rights:

  • Right to disclosure: You have the right to know if information in a consumer report has been used against you.
  • Right to know what is in your file: You have the right to request and obtain all the information about you in the files of a consumer reporting agency.
  • Right to dispute incomplete or inaccurate information: If you identify information in your file that is incomplete or inaccurate, you may dispute it, and the consumer reporting agency must investigate your dispute unless it is frivolous.
  • Right to have inaccurate information corrected or deleted: Consumer reporting agencies must correct or delete inaccurate, incomplete, or unverifiable information, typically within 30 days.
  • Right to pre-adverse action notice: Before HALOFIX takes any adverse action based in whole or in part on information in a consumer report, you will be provided with a copy of the report and a description of your rights under the FCRA.
  • Right to a free annual report: You are entitled to one free disclosure of your consumer report every 12 months from each nationwide consumer reporting agency.
  • Right to seek damages: You may sue a consumer reporting agency or an information furnisher that violates the FCRA in state or federal court.

Pre-Adverse and Adverse Action Notice

If HALOFIX decides to take adverse action based in whole or in part on information contained in a consumer report, HALOFIX will provide you with: (1) a copy of the consumer report relied upon, and (2) a written description of your rights under the FCRA (Summary of Rights), at least five (5) business days before taking the adverse action. You will then have the opportunity to dispute the accuracy or completeness of any information in the report.
