Anti-Circumvention Policy

How HALOFIX USA protects marketplace integrity for all participants.

Why This Policy Exists

HALOFIX USA invests in vetting Heroes (background checks, license verification, insurance validation), providing warranty coverage, payment protection, and dispute resolution. When users circumvent the platform to transact directly, they lose these protections and the marketplace cannot sustain the investment that makes them possible.

Hero Non-Circumvention Covenant

For 12 months following your last completed job through HALOFIX USA, you agree not to solicit, accept, or perform services for any Resident you were connected with through the platform outside of the HALOFIX USA marketplace. Violation subjects you to liquidated damages equal to 5x the platform commission that would have been earned, which the parties agree is a reasonable pre-estimate of HALOFIX USA LLC's losses and not a penalty (per FL §768.041).

Resident Non-Circumvention Agreement

For 12 months after your last booking through HALOFIX USA, you agree not to solicit or hire Heroes you were connected with through the platform for off-platform services. Violations may result in forfeiture of warranty coverage, dispute resolution support, and payment hold protections.

Enforcement Mechanism

Strike System

Violations accumulate as strikes within a rolling 30-day window. Reaching 3 strikes triggers admin review and potential account suspension.

Liquidated Damages

Heroes who violate the non-circumvention covenant are subject to liquidated damages equal to 5x the platform commission that would have been earned. This amount is a reasonable pre-estimate of HALOFIX USA LLC's losses, not a penalty (per FL §768.041).

Account Termination

Accounts terminated for anti-circumvention violations are subject to permanent suspension. Identity fingerprinting may be used to prevent related accounts. Appeals may be submitted to (786) 550-2580.

Blocked Content in Platform Messaging

To prevent circumvention, HALOFIX USA filters the following content categories from in-platform messages between Residents and Heroes:

Phone numbers
Email addresses
Physical addresses
URLs and website links
Social media handles
Payment app handles (Venmo, Zelle, CashApp)

Filtered messages are flagged for review. Repeated attempts to share contact information are counted as strikes.

Duration

The non-circumvention obligation applies for 12 months following the last completed job between the parties through HALOFIX USA. After this period, the parties are free to transact independently.
